The Education and Care Services (ECS) Commissioners are independent, statutory officers appointed by the Education Council under the Education and Care Services National Law. Ministers have appointed 2 people to undertake the roles; a Freedom of Information Commissioner, and a Privacy Commissioner and Ombudsman.

The ECS Commissioners derive their powers from the following Commonwealth legislation, as modified by the Education and Care Services National Regulations (ECS Regulations):

  • the Freedom of Information Act 1982;
  • the Privacy Act 1988; and
  • the Ombudsman Act 1976.

Under ECS Regulations 198, 207 and 221, the ECS Commissioners are required to submit an annual report to Education Ministers to table in their respective Parliaments.
