Your Child Care Subsidy (CCS) provider or service approval can be cancelled. Approval may be cancelled if you fail to comply with your obligations or if your National Law approval is cancelled.

What can my approval be cancelled for?
We can cancel your CSS approval for not complying with the conditions of continued approval under Family Assistance Law (FAL). This includes where:
- you fail to provide care for 3 continuous months
- you cease to operate all the approved services for which you are approved as a provider
- you no longer have any services for which you are approved as a provider
- there are serious risks to CCS payments and/or child safety and wellbeing.
We can also cancel your CCS approval if your National Law provider or service approval is cancelled.
Before we impose a cancellation, we consider:
- your past behaviour or compliance history
- your response to any earlier non-compliance action
- whether your non-compliance:
- has resulted in, or could result in, significant and multiple overpayments of CCS and ACCS
- demonstrates that you are no longer a fit and proper person to provide a child care service
- poses an unacceptable risk to the safety, health or wellbeing of children being cared for in one or more services for you are approved.
We will issue you a notice of intention to sanction/cancel before making a decision.
What happens if CCS approval is cancelled?
If your CCS approval is cancelled, we will issue a notice with the date the cancellation takes effect (which may be earlier than the day the notice is given).
You will not be able to claim CCS. However, you can continue to provide care if you still have National Law approval.
What happens if National Law approval is cancelled?
If your National Law approval is cancelled:
- you cannot operate any approved education and care service
- we will automatically cancel your CCS approval – this is because it is a condition of CCS approval that you are approved under the National Law. We will give you notice of this cancellation.
If a provider approval is cancelled, all service approvals held by the person who was the approved provider are also cancelled.
