Annual review of state and territory funding contributions

On this page:

Under the Australian Education Act 2013 (the Act), the Board is required to conduct an annual review of state and territory compliance with section 22A of the Act.

Section 22A of the Act states that as a condition of Commonwealth financial assistance, states and territories are required to meet minimum school funding contributions.

From 2025 these requirements are set out in each jurisdiction’s bilateral agreement with the Commonwealth under the Better and Fairer Schools Agreement (2025-2034).
The Section 22A terms of Reference ask the Board to take into account:

  • the terms of Bilateral Agreements with individual jurisdictions under the Better and Fairer Schools Agreement 2025-2034 and Better and Fairer Schools Agreement – Full and Fair Funding 2025-2034.
  • contributing or mitigating circumstances that have contributed to any non-compliance, and
  • timing of state budget processes and impact on compliance and reporting arrangements.

The Australian Government Department of Education provides reporting guidance to assist states and territories to report on their annual funding contributions.

Note: Between 2018 and 2024 , section 22A compliance reviews were conducted against the minimum funding contributions set out in bilateral agreements under the former National School Reform Agreement, and in accordance with the previous Section 22A terms of reference.
